Summary

The Act of 20 May 2016 on investments in the field of wind power plants sets out special rules for the planning, construction and location of wind farms in Poland, including spatial planning requirements and conditions for siting turbine installations. Over time this Act has been amended to liberalise wind energy development — most notably by the Act of 9 March 2023, which relaxed the stringent distance rule that previously prohibited turbines within ten times their height from residential buildings by allowing siting under local spatial plans with a minimum distance of 700 meters instead of the 10H rule, creating more opportunities for onshore wind projects.
