This Law establishes an economic subsidy for public electricity distribution service concessionaires with their own markets of less than 350 GWh per year and creates the Just Energy Transition Program (TEJ). It extends the authorisation of the Jorge Lacerda Thermoelectric Complex (CTJL) for 15 years starting in 2025.
The TEJ aims to prepare the coal region of the State of Santa Catarina for the probable termination, by 2040, of the national coal-fired thermoelectric generation activity without abatement of carbon dioxide (CO2) emissions, with the consequent completion of the exploration of this ore in the region for this purpose, in a timely, responsible and sustainable manner (art 4.1).
Among other responsibilities, the TEJ's Council will have to consider the local capabilities for technological development with a view to enabling other uses for the region's mineral coal or the continuity of coal-fired thermoelectric generation with net carbon emissions equal to zero from 2050 onwards (art 5.VI).
Amends Law 10.438/2002, establishing the Programme of Incentives for Alternative Electricity Sources (PROINFA) and law 9.074.
