Enforcement Regulations of the Air Quality Conservation Act

These regulations were first issued by a Prime Minister Decree in 1991 and passed through several amendments throughout the years, mainly by Ministry Environment Ordinances. The last amendment entered into force on 01 July 2025.The purpose of these regulations is to regulate matters delegated by the Clean Air Conservation Act and its enforcement decree considering their enforcement. It sets setting binding standards and procedures to control eleven key air pollutants—including nitrogen oxides (NOₓ), sulfur oxides (SO₂), particulate matter (PM), and volatile organic compounds (VOCs). Furthermore, it legislates about monitoring and alerts systems, facility controls and regulatory areas and strategic planning. Chapter 4, section 2, establishes standards for Automobile GHG emissions management.

The purpose of this Act is to prevent air pollution. Article 9 states that the Government shall participate positively in international efforts, such as the exchange of environmental information and technologies with other nations, and devise policies for research and surveys, recovery and recycling, development of substitutes, etc. for the reduction of emissions of climate/ecosystem-changing substances. Article 11 charges the government to establish plans to reduce greenhouse gases emissions.

Enforcement Decree of the Air Quality Conservation Act

Presidential Decree No. 25144

The purpose of this Act is to define the details required for implementing the Clean Air Conservation Act, ensuring effective enforcement of the law by specifying procedures, standards, responsibilities, and technical criteria not established directly in the Act.The decree defines the pollutants subject to emission surcharge, amid them GHG-related gases such as Sulfur Oxide, regulates air pollutant emissions in living environments and from vehicles, including GHG emissions.

Any compulsory, unrequited payment to the government levied on corporations or individuals. This can be for environmental reasons, such as introducing a Carbon tax to set a price that emitters must pay for the greenhouse gases they emit.

Tradable permits are market-based tools that grant permission for specific activities, frequently used to regulate emissions. These permits can be issued within a trading system to manage environmental impacts.

A ban is a legal action that prevents the sale or supply of a product or service, or that recalls a product from the market. Examples are bans on SF6, greenwashing, fossil fuel advertisement or single-use plastics.
