Legislative process

The legislative process of Tunisia is governed by the 2022 Constitution of the Tunisian Republic. Under the said Constitution, Tunisia has a bicameral Parliament called the House of Representatives, made up of the first House of Representatives, called the National Assembly of the Representatives of the People (NARP) and a second House of Representatives, called the National Council of Regions and Districts (NCRD). Members of the NARP are elected in a universal direct election for five years, whilst directly elected members of regional councils select members of the NCRD. To make up the NCRD, the people directly elected to regional councils in each region elect one representative to represent the region in the NCRD.

The President and the Representatives have the power to present suggestions for laws. The President has an unfettered right to do so, and he/she has the sole responsibility of presenting draft laws on approving treaties and draft finance laws. Priority is also given to bills suggested by the President. The Assembly may also, for a limited period and for a specific purpose, authorise the President to draft decrees and submit them for approval by the Assembly. Additionally, Representatives can present bills and suggestions for laws, subject to the bill being sponsored by at least 10 representatives. The NARP approves basic laws by an absolute majority of members and ordinary laws by a majority of the members present, provided that this majority is not less than one-third of the members of the Assembly. The administrative court and the Constitutional court have jurisdiction to hear matters submitted by the President on any disputes regarding draft laws.
