Summary

The Regulations were made in terms of section 140 (2) (b) of the Environmental Management Act and outline the legal framework for managing substances and equipment that affect the ozone layer and climate. The Regulations apply to “private and public individuals, industrial and commercial importers, exporters, producers, and consumers of ozone-depleting substances and greenhouse gases … and ozone-depleting substances and greenhouse gas-dependent equipment” listed in the regulations. Licenses are required for importing, exporting, and transiting the controlled substances and equipment, with detailed procedures for application and issuance.
