Summary

This broad legislation is meant to decentralise governance in the country and is a pillar of the juridical-legal framework of contemporary Peru. As such, most of the legislation is unrelated to climate change or the natural environment. However, it states explicitly that regional governments must formulate, co-ordinate, manage and supervise regional strategies to address climate change within the national framework (the National Strategy on Climate Change and additional legislation, executive decrees and ministerial resolutions).Law 31812 modifies Article 15(k) of Law 27867, the Organic Law of Regional Governments, to secure financing for the fiscal‑oversight function of Regional Councils (Consejos Regionales) and, by analogy, of Municipal Councils under Law 27972. The amendment stipulates that the Regional Government’s Institutional Opening Budget (PIA) must allocate, within the appropriate budgetary classifier, the financial resources required to provide the Council with the logistical means and professional support necessary to carry out its auditing and supervisory duties over regional public administration.
