Ecological and Environmental Code

This Code aims to protect the ecological environment, prevent pollution, protect public health and ecological environment rights and interests, maintain ecological safety, promote green and low-carbon development, build an ecological civilisation, comprehensively promote the construction of a beautiful China, accelerate the modernisation of harmonious coexistence between man and nature, and realise the sustainable development of the Chinese nation. It contains 1242 articles over five parts: -

<li>Part I on General Principles, including general principles and fundamental regulatory schemes, including planning, monitoring, environmental impact assessment, and information disclosure and public participation;</li>
<li>Part II on pollution control;</li>
<li>Part III on ecological protection;</li>
<li>Part IV on green and low-carbon protection, which contains specific provisions on climate change adaptation and mitigation; and</li>
<li>Part V on Legal Liability and Supplementary Provisions.</li>
</ol>
The Code incorporates 10 existing environmental statutes, including the Environmental Protection Law, the Law on the Prevention and Control of Air Pollution, the Cleaner Production Promotion Law, and others, which will now be repealed following the entry into force of this Code on 15 August 2026.
Crucially, the Code introduces a general statutory framework for climate governance. 
Part IV (Articles 938 to 1051) focuses on activities related to green and low-carbon development, such as the development of the circular economy, energy conservation and green low-carbon transformation, and the response to climate change. These activities cover the areas of economic and social development, spatial planning, industrial structures, modes of production and a green lifestyle.
Article 942 states: The State shall adopt policies and measures to actively respond to climate change, control and reduce greenhouse gas emissions, actively and steadily promote carbon peaking and carbon neutrality, enhance the ability to adapt to climate change, and raise the awareness of the whole society to cope with climate change.
Other provisions outline how the State shall promote the green and low-carbon transformation in various industrial sectors, including steel, non-ferrous metals, petrochemical, chemical, building materials, papermaking, printing and dyeing and other industries, as well as other sectors, namely transport, buildings, and agriculture. The State shall also establish green low-carbon product standards, optimise investment mechanisms, strengthen research and strengthen international cooperation. There are also State obligations in respect of promoting recycling, energy conservation, green design and manufacturing, and public education on green consumption.
Articles 1025 to 1051 are dedicated to climate change mitigation and adaptation. These Articles cover the responsibilities of various state agencies, with the Ministry of Ecology and Environment responsible for the national response to climate change and the National Development and Reform Commission (NDRC) (the third-ranked ministerial-level cabinet department of the State Council of China) responsible for the management and coordination of the work contributing to the national carbon peak and carbon neutrality targets. 
These Articles also set out initiatives that the State shall develop in respect of climate change, including carbon accounting, a compulsory national carbon emissions rights trading market, a voluntary national greenhouse gas emissions reduction trading market, regional adaptation measures, an early warning and assessment system of climate-induced disasters and the assessment of climate change health risks and public health adaptation actions. The State shall also actively participate in global climate governance and adhere to the principles of common but differentiated responsibility, the principle of fairness and the principle of respective capabilities.
These provisions concern the creation of plans:

<li>Article 1032 mandates the State to fully integrate the requirements of the carbon neutrality target into the national development plan and to promote climate change mitigation through the carbon peaking and carbon neutrality targets. </li>
<li>Article 1034 mandates the NDRC to prepare the national carbon peaking and carbon neutrality action plan and organise its implementation, alongside relevant ministries. </li>
<li>Article 1041 mandates the provincial, autonomous region and municipality governments to formulate action plans for climate change adaptation for their administrative regions and organise their implementation. </li>

Policy instruments are techniques or tools used by governing authorities to promote certain policies in order to achieve predetermined goals. Put simply, instruments are how a government tries to achieve its goals, with this taxonomy being focused on national policy instruments.

Risk is the potential for adverse consequences resulting from the dynamic interplay between (climate-related) hazards, exposure, and vulnerability of affected human or ecological systems.

The management and allocation of funds, assets and investments to meet various objectives

Terrestrial means "of the earth" and relates to the risks to ecological system that includes all living organisms and their interactions within land-based environments, such as forests, grasslands, and deserts.

Any compulsory, unrequited payment to the government levied on corporations or individuals. This can be for environmental reasons, such as introducing a Carbon tax to set a price that emitters must pay for the greenhouse gases they emit.

Actions or measures to adapt terrestrial systems to climate change.

This sector includes firms and individuals offering specialised expertise in fields such as law, accounting, consulting, science and engineering.

A ban is a legal action that prevents the sale or supply of a product or service, or that recalls a product from the market. Examples are bans on SF6, greenwashing, fossil fuel advertisement or single-use plastics.

An integrated system of hazard monitoring, forecasting and prediction, that enables individuals, communities, governments, businesses and others to take timely action to reduce disaster risks in advance of hazardous events.

Energy derived from biological compounds that are renewable due to their short life cycle within the carbon dioxide cycle.

A drought is an extended period of unusually dry weather marked by a significant and sustained lack of precipitation, falling below a specific threshold over a large area for more than a month

Air pollution involves harmful contaminants in the air, affecting both indoor and outdoor environments. It can lead to health issues like respiratory diseases and heart problems, and climate impacts such as global warming. Pollutants can damage plants, trees, habitats, and water bodies like rivers and lakes.

Activities that provide lodging, food, and entertainment services to guests, including hotels, restaurants, and resorts.

Financial support to help individuals manage the effects of unexpected events, securing their livelihoods and increasing the resilience of people and businesses to the changing climate. It’s especially vital in developing regions where everyday risks, climate-related weather extremes, or crop failures can push people into poverty. Without insurance, people may have to resort to selling assets or cutting consumption to cope with losses.

Climate change impacts our society by disrupting the natural, economic and social systems we depend on. Physical hazards and underlying vulnerabilities can lead to increased resource competition for food and water, which can heighten the risk of conflict.

This sector provides communication services, software development, and IT solutions.

Codes and standards are regulatory instruments that specify minimum standards to protect health and safety. This ranges from performance standards, which prescribe outcomes while allowing flexibility to achieve compliance, to the more prescriptive approach of technology-specific standards.

This sector involves activities to move goods and people, alongside the storage of products.

Fossil gas, commonly known as natural gas, is a fossil fuel consisting chiefly of methane with smaller amounts of other hydrocarbons and trace gases, found in underground deposits.

This sector involves the wholesale and retail selling of goods.

A long-lived, colourless gas, chiefly emitted from fossil fuel combustion, deforestation and cement production.

A subsidy is a direct or indirect payment to individuals or businesses, typically provided as a government cash payment or a specific tax reduction.

Human activities also cause technological impacts, such as the risks posed by oil spillage and leaks.

Slow onset events evolve gradually from incremental changes over many years or from increased frequency or intensity of recurring events. As defined in the Cancun Adaptation Framework (2010), slow onset events include risks and impacts from rising temperatures, desertification, biodiversity loss, land and forest degradation, glacial retreat, ocean acidification, sea level rise, and salinization.

Extreme weather refers to events where a weather variable exceeds (or falls below) a threshold. Meaning it is significantly different from the average or usual weather pattern.

Geohazards are adverse geological phenomenon's that are capable of causing widespread damage or loss to property, life and the environment, such as earthquakes, volcano eruptions and tsunamis. Climate change can increase the frequency and severity of some geohazards, such as landslides, and soil erosion.
