Decree No. 2022-1295 relating to the obligation to close the openings of buildings or parts of buildings for tertiary use, heated or cooled

This decree amends the Code of Construction and Housing to introduce the following clauses:

" Art. R. 175-7.-I.- The openings of any building, or part of a building, in which market or non-market tertiary activities are carried out, including that belonging to a natural or legal person in the primary or secondary sector, heated or cooled using one or more heating or air conditioning systems, within the meaning of Article R. 175-1, overlooking outdoor spaces or an unheated or cooled part of the building, are equipped with manual or automatic closing systems limiting heat loss.
“II.- When one or more of these heating or air conditioning systems are in operation, these closing systems must not, under normal operating conditions, be kept open by the operator of the building or part of the building concerned. , including during opening hours for users.
“This provision does not apply when indoor air renewal requirements require it in order to prevent the risks mentioned in Article L. 153-2 or when the recommendations of the health authorities recommend it.
