Law No. 13.576/2017  establishes the National Biofuel Policy - RenovaBio, and details for its principles, objectives, fundamentals and instruments. RenovaBio provides for 1) Biofuels certification, 2) the goals of reducing GHG emissions in the fuel matrix and 3) issue and trading decarbonisation credits(CBios ). Normative Resolution 14/2017 sets the strategy for RenovaBio. Decree 9.308 details the application of the law. Normative Resolution 5/2018 sets annual compulsory goals for the reduction of GHG emissions from fuels.

This resolution defines the compulsory annual greenhouse gas emission reduction targets for the sale of fuels for the years 2019 to 2029 by defining compulsory annual greenhouse gas emission reduction targets for the whole sector sale of fuels and their respective tolerance intervals, established in units of Decarbonisation Credits (CBIOs).

Resolution CNPE 15/2019

This resolution defines the compulsory annual greenhouse gas emission reduction targets for the sale of fuels for the years 2020 to 2030 by defining compulsory annual greenhouse gas emission reduction targets for the whole sector sale of fuels and their respective tolerance intervals, established in units of Decarbonisation Credits (CBIOs).

Resolution CNPE 8/2020

This resolution defines the compulsory annual greenhouse gas emission reduction targets for the sale of fuels for the years 2022 to 2031 by defining compulsory annual greenhouse gas emission reduction targets for the whole sector sale of fuels and their respective tolerance intervals, established in units of Decarbonisation Credits (CBIOs).

Resolution CNPE 17/2021 

This resolution defines the compulsory annual greenhouse gas emission reduction targets for the sale of fuels for the years 2023 to 2032 by defining compulsory annual greenhouse gas emission reduction targets for the whole sector sale of fuels and their respective tolerance intervals, established in units of Decarbonisation Credits (CBIOs).

Resolution CNPE 13/2022 

This resolution provides for the individualisation of compulsory annual greenhouse gas emission reduction targets for all fuel distributors for the marketing of fuels, within the scope of the National Biofuels Policy (RenovaBio). The fuel distributor's individual annual greenhouse gas reduction target will be an integer greater than zero, calculated by multiplying the distributor's market share of total fossil fuel emissions (as a percentage fraction) by the annual target set by the National Energy Policy Council (CNPE).

Resolution ANP 791/2019, altered by Resolution ANP 843/2021 from the National Agency for Oil, Natural Gas and Biofuels (ANP)

This ordinance provides for the bookkeeping, registration, negotiation and retirement of the Decarbonisation Credit (CBios) under the National Biofuels Policy (RenovaBio).

Ordinance MME 56/2022 from the Ministry for Mines and Energy

This resolution regulates the certification of the efficient production or import of biofuels referred to in article 18 of Law no. 13.576, of 26 December 2017, and the accreditation of inspection firms. It was amended by Resolution ANP 802/2019 in December 2019, which established the procedures for generating the necessary ballast for the primary issuance of Decarbonisation Credits, referred to in Article 14 of Law No. 13,576, of 26 December 2017.
